New Jersey Lead Information

IMPORTANT: Listing your property on NJHousing.gov IS NOT the same as registering your property with the State of New Jersey Lead Registry. Read Below for descriptions and definitions.

There are three lead-safe certificates (lead-free, lead-free interior, lead-hazard free) issued by State-certified Lead Evaluation Contractors. In New Jersey, Lead Evaluation Contractors are certified to perform lead-based paint inspections and risk assessments. Owners interested in acquiring a certificate can call an Evaluation Contractor for information. A list of certified Evaluation Contractors is available via Lead Hazard Abatement Program site or by calling 1-609-633-6224. Evaluation Contractors have also been advised about specific reporting requirements for all the certificates that they issue. Reporting requirements take effect July 1, 2005. A State web site will be available soon.

DEFINITIONS:

My unit was constructed after 1977 and is therefore presumed to be Lead Free.
 

 
My unit has had an inspection and was found to be Lead-Free.
 
"Lead-free" means having no lead-based paint on any surface within a dwelling unit, common area or building.
 
This means that a licensed lead evaluation firm has performed a surface-by-surface evaluation of the painted/coated components and surfaces of the interior and exterior of the building including both habitable and non-habitable space and found no lead-based paint.
 
My unit has had an inspection and was found to be Lead-Free Interior.
 
"Lead-free interior" means having no lead-based paint on any interior surface within a dwelling unit, common area or building. For the purpose of this definition, interior surface shall include any part of a door or window system other than the exterior casing.
 
This means that a licensed lead evaluation firm has performed a surface-by-surface evaluation of the painted/coated components and surfaces of the following areas and found no lead-based paint:
 
For single-family housing: all interior surfaces and components within the dwelling´s exterior walls or within the dwelling´s common walls if a row house, townhouse or if there is an attached garage or other structure. The owner may request that the lead evaluation contractor test and include any areas beyond the exterior walls such as porches, balconies or garages in the lead-free interior certification. Interior surfaces and components in both habitable and non-habitable space must be tested.
 
For two-family and multi-family housing: a lead-free interior of a dwelling unit means all interior surfaces and components within the dwelling unit are free of lead-based paint. The owner may request the lead evaluation contractor test and include exterior surfaces, interior and exterior common areas. Interior surfaces and components include habitable and non-habitable space. Multiple dwellings certified to have a lead-free interior remain subject to the lead-safe housing maintenance requirements for any units and exterior or common areas that are not specifically included in the lead-free interior certification.
 
My unit is Lead Abated.
 
This means that following a lead risk assessment, all lead paint hazards were identified and abated.
 
My unit had a lead risk assessment and all identified lead paint hazards were abated. The name of the contractor who performed the risk assessment is (fill in name); the name of the contractor who performed the abatement work is (fill in name); and a Certificate of Clearance was issued by the local construction code official on (fill in date).
 
My unit is Lead Hazard Controlled.
 
This means that following a combined inspection/risk assessment, lead hazards have been addressed using interim controls and workers trained in lead-safe work practices, taken clearance samples using trained technicians, and am following a maintenance plan to prevent lead hazards from re-occurring.
 
My unit had a combined inspection and risk assessment. The name of the contractor who performed the testing is (fill in name). All lead paint hazards were treated using workers trained in lead-safe work practices. The lead treatments were interim controls (temporary measures, such as stabilizing deteriorated lead-based paint surfaces by removing deteriorating paint and repainting) or rehabilitation performed using lead-safe work practices. Following the completion of lead treatments, I used trained people to obtain dust wipe testing that showed that the work areas were properly cleaned and have no lead dust hazards. I am following an ongoing maintenance plan that includes a monitoring schedule together with a written description of the monitoring or surveillance that I am performing to insure: 1) that known or suspected lead-based paint is not deteriorating, 2) that lead-based paint hazard controls, such as paint stabilizations have not failed, 3) that structural problems (such as leaks) do not threaten the integrity of lead hazard control measures or treatments or of known or suspected lead-based paint.
 
My unit receives "Standard Treatments."
 
This means that the unit has not been tested for lead-based paint but the owner follows maintenance practices known as "standard treatments."
 
My unit has not been tested for lead-based paint but I have presumed any painted and coated surfaces in the property are lead-based paint and I have instituted "standard treatments" as they are defined in state regulations at N.J.A.C. 5:10. Examples of some of the standard treatments I follow are: 1) provide smooth and cleanable horizontal surfaces 2) correct building conditions that cause rubbing, binding, friction or crushing of painted surfaces 3) obtain periodic dust wipes on carpet to insure it does not indicate lead levels above the clearance levels specified in state regulations 4) perform periodic visual inspections for deteriorated paint and the causes of deterioration. I use workers trained in lead-safe work practices to perform the standard treatments.
